Burglary Attorney
If you or someone you know is under investigation or has been arrested for burglary, your future and your freedom are at risk.
In Illinois, burglary is defined as when a person, who without authority knowingly
enters or without authority remains within a building, housetrailer, watercraft, aircraft,
motor vehicle as defined in the Illinois Vehicle Code, railroad car, or any part thereof,
with intent to commit therein a felony or theft.
Burglary is a Class 2 felony and carries a penalty of 3 to 7 years in prison but the
penalties can be enlarged if the burglary is committed in a school, day care center,
day care home, group day care home, or part day child care facility, or place of
worship. Burglary charges in Illinois are generally Class 2 felonies, but if the burglary
took place in a school or place of worship, it will be charged as a Class 1 felony,
punishable by 4 to 15 years in prison.
Possession of burglary tools charges are often paired with burglary charges or
residential burglary. Possession of burglary tools is a Class 4 felony that carries a 1
to 3 year prison sentence. Possession of burglary tools occurs when an individual
possesses a piece of equipment (explosives, keys, etc.) that could be used to break
into another’s dwelling, watercraft, aircraft, etc.
